The ongoing investigation into allegations of domestic violence against incoming Sheriff Ross Mirkarimi has prompted Superior Court Judge Katherine Feinstein to withdraw from administering his oath of office.
Feinstein, who had been invited to administer the oath today at the ceremony at the Herbst Theatre, said in an e-mail Saturday that "given that there is a pending investigation, and the possibility that a case might be brought before our court, I did not want to create a potential legal conflict in the future."
Feinstein is one of many city officials who suddenly find themselves walking a legal and political tightrope as a result of a neighbor's call to police alleging that Mirkarimi, a longtime progressive supervisor, had grabbed and bruised wife Eliana Lopez's arm during a heated argument over the New Year's weekend.
"Everyone involved in this case, from the police to the district attorney, are going to be getting it from both sides," said former police commissioner and Golden Gate Law School Dean Peter Keane.

Mirkarimi is a communist who hates cops. He only got two votes from the sheriffs. He sided with the black panthers and anyone else who has killed a cop. Why in God's name is this guy the Sheriff?? Stupid people are ruining America.
Ross Mirkarimi was co-founder of the Green Party of CA, and "coordinated Ralph Nader's Presidential campaign in CA (2000)". In 2010 Mirkarimi changed his party affiliation to Democrat. He won his San Francisco election for Sheriff. From that link, you may wish to read why Sheriff Mike Hennessy supported Ross Mirkarimi to be his successor, Mirkarimi is qualified.
I am a big fan of golfers and others who are saving our valued Sharp Park Golf course. I'm no fan of Brent Plater, or other people who cannot work at representing correct information. Oh I forgot, apparently Anon (1/8, 7:32) thinks anyone who is not a Fascist is a Communist. Limited view, isn't it?
Communists need a political party too. That is why communists flock to the democrat party , so they can be recognized. Get it?! Check out the Communist Party USA website. They are a very sick bunch of people. Scary shit.
Nice headline Steve, nothing like smearing someone through guilt by association. How does this sound.... Steve Sinai, friend of child molester XXXX was seen stuffing his hole at McDonald's yesterday.... comfy?
Anon@11:28, do you think it would tarnish my reputation if people found out I ate at McDonalds?
Mirkarimi is refusing to cooperate in the police investigation of his potential domestic assault. That's enough for me to decide he's unqualified to be sheriff.
Sinai... no, it would smear McDonald's.
Wipe that ketchup off your chin Steve, I was insinuating you were smearing Plater... duh.
Anon (1127) given the current state of the obstructionist far-right Republican party take-over, by contrast its probably better that Democrats have on board a few "greens" who can't find their own party.
Last time I checked, which was a second ago, the democrats have the WH and Senate. Meeh, the republicans are not in charge of anything except what your leader states you HAVE to say. Some day you will find out what it means to FREE YOUR MIND.
Anon (541), stop pretending. Yes, the Republican majority now have the House, and by filibuster default the minority Republicans also hold the Senate hostage. Never before has the filibuster been used as a frequent strategy to block "everything" that should have REASONABLE COMPROMISE.
That's it, Republicans hold dysfunctional control of the House by numbers and the Senate by default. Therefore, important legislation has for the most part shut-down. Maybe in the spirit of "do no harm" the country would be better off if the House and Senate just stay on vacation.
The Executive branch is doing what it can, but executive powers are limited. The latest good deed from President Obama was to appoint the long outstanding position of Richard Cordray to head of the new Consumer Financial Protection Bureau. Finally that got done through "recess appointment", (again suggesting the country might be better off (and more would get done) if the Republican controlled House and Senate would stay on vacation, recessed.
Meantime, my mind is just fine, still thinking. Yours apparently not so much.
Meantime, I'll post hundreds of times with countless grammatical errors to prove how fine my mind is.
Count on it, Anon.
That's what she's trying to prove?
Based upon your own comments, Anon (1004, 541), you may say "how fine" your mind is, but it does not appear to be working well, factually or comprehensively.
Congratulations though on short, perfect sentences, simple vocabulary, no spelling, grammar or typo errors! Priorities I guess.
Priorities? No. Clear, concise writing skills are an important communication tool needed to successfully convey your ideas and observations to the reader. The mangled stuff you grind out is hard to read and represents you poorly. You have things you want to say. Care more, write clearly, or why bother?
Anon (348), zzzzz. Priorities, yes. And, your prior ESL comment was way over the top.
The implications of that comment were chilling. Chilling not for me, I do my best, but my typos and periodic complication of thought and sentence structure is probably not going away (so get over it). Your ESL comment was chilling for those who are less skilled and also have something to say.
If you conveyed your "clear, concise" comment 1/9 at 5:41pm, I think you need to spend more time understanding the issues.
"...why bother?" zzzzz. One of the efficiencies of this blog is to share what information, and humanity we can, rather than use the forum for anonymous target practice. But that up to you, and maybe then you'll be able to step-up to using your own name.
Much better Kathy. Keep up the effort.
