Council should follow their own rules. Tod was being heckled by the nimby's and they did nothing to stop it. As a result he ended up having an exchange with the audience. The hecklers should have been ejected. Instead they blamed Tod for something they allowed to happen. You need to apply the same rules for everyone, regardless of your feelings towards them.

Business Improvement District--a chamber run hotel room tax designed to promote Pacificas tourist economy. Consent item 3.
Apparently Council will not even read the report to find out
1. no data on how many tourists this fund brings in.
2. they have so much $$, $37,000 not spent last year and carried into 2014. Seems if you are full press on improving the economy, spend it all?
3. chamber pays itself $35K to manage a $27K PR agency.
4. will have a $17K surplus this year, but still whine about citys $10K dole.

Those hecklers are just playing 'Poke Tod'. He loses every time because he can't ignore the hecklers. Council meetings are getting too squirrely, even by Pacifica standards and we simply can't have that. Nihart will squash him like a bug. Oh well.

Tom, the sewer reserve fund is gone. Other broke-down cities are running the same desperate game. In litigious CA some irate rate-payer group will probably stop them again in court and turn that loophole into a legal noose. It'll be too late for Pacifica. Council is going to pluck that golden goose bare. I wonder how high those sewer rates can go?

10:02. Revisionist history. Tod was out of order and the crowd objected. He was not addressing the council, he was attacking other individuals by name. As usual, the council did nothing to rule Tod out of order so the situation degenerated into him giving 2 middle fingers to the audience and it went downhill from there.

The rules of city council meetings have to be followed and enforced fairly across the board. If the nimby's are yelling, toss them.

I think this plan to borrow from the sewer fund is brilliant. Seriously. These cuts we kick around are bullshit. Either they are impossible to make, can't be sustained, or they are pain for no gain. Pacifica voters won't vote for a tax. Council, and whomever they share a brain with, has found a nice, quiet way to get the money the city needs. It's from us--duh, but with the exception of a few interested Pacificans, most property owners just see it all as property tax. They're often oblivious to the city connection. It's kinda generic and apolitical. As long as council doesn't ask for huge increases, and, the courts don't again step in, they've got the funding they need. People pay their property taxes. Kicking the can down the road? Sure. And we rate-payers regularly refill the can. Fucking brilliant. Welcome to America. The passage of time is the politicians best friend.

I don't think it's funny to watch the guy disintegrate. He takes the bait because he can't stop himself. He baits others for the same reason. Nihart's a psych nurse. What do you think her opinion of him is? IMHO Ervin did what she could for Tod when she asked him to just address council, not the audience, and she did it with kindness. Where will this end?

The 3 minutes are the speakers to speak to council. Not the nimbys to heckle him before and during his speach.

1240, anyone who speaks to city council (within city guidelines during citizen communication) has 3 minutes to speak period. Whereas, anonymous personal attacks against those who speak are cowardly and ethically worthy of ridicule.

From the televised view of Tod speaking (5/12/14), it was apparent that harassment was coming from the anti-highway widening crowd (something like 30 them, 1 Tod). As 1233, 1145, 1002 said the crowd was out of order. And as Tod said, "I didn't harass others in the crowd or when they spoke".

As 122 suggests the core issue in this city is not enough money. And the focused solution to save this city, and allow this city to prosper is??? (This question doesn't get easier as we ignore the issue, and move into the future).

It's not about Highway 1 if it is safe or not. It is about Loeb and his gang of goons controling city council.

If these goons don't get their way they pout cry to council and file a lawsuit crying to court to be made right.

Ha, if Nihart achieves nothing else in 8 years as a council person besides banning Tod for life she will have done enough. The whole tax the working poor to pay the working wealthy thing (thankfully) has been a red herring, but banning Tod from council chambers even for 6 months would be a crowning achievement. It's long past due.

Here are the rules of order for Oral Communications, as published on every City Council agenda:

"All remarks shall be addressed to the Council as a body and not to any member thereof."

"Pursuant to Pacifica Municipal Code Title 2, Chapter 1, Section 2-1.118 any
person making impertinent, slanderous, or profane remarks or who becomes boisterous
while addressing the Council shall be called to order by the presiding officer and, if such
conduct continues, may, at the direction of the presiding officer, be ordered barred from
further audience before the Council during the meeting."

Tod violated these rules of order before the crowd started yelling their objections to his behavior. Tod regularly violates these rules of order every time he speaks in Oral Communications.

Imagine all these years Tod has managed to escape what you deem to be violations of city council rules. And he got by with it, imagine! Guess that's because he's king, and you're anonymous.

As for that "crowd started yelling their objections to his behavior" thing-- that (what you said) proves, the crowd was disorderly and misbehaved. Where's your city ordinance regarding crowd behavior during a city council meeting?

But considering Tod's comments at the podium regarding the crowd harassing him, its logical to assess that the anti-highway crowd harassment of him began prior. Got anything else?

The 30 to 1 thing does make it seem unfair. Toss Tod and be a hero to some or toss the group and be accused of silencing opposition to the highway widening? Ervin took the easy way out. Her idea?Making a just decision between Tod's behavior and that of the hecklers would challenge Solomon. Better they all stay or they all get ejected. It's only 3 minutes, not a life sentence. The principle behind the public forum, even for the obnoxious, is a lot more important than the image of the mayor or her stand-in.

Tod wore out his welcome with the current regime when he began to publicly criticize them. Unlike Ervin to act so independently. If a ban is the plan, it should require a public council vote.

The nimby's think if they repeat something enough we will believe it. Truth is truth. They WERE heckling Tod first. They should have been stopped, but Ervin was in over her head.

I was at the last meeting, and Tod called me out, as well as a few others, from the podium, in clear violation of the rules. When a few members of the audience (not me) pointed out that that was against the rules, he flipped everyone off. Tod has repeatedly flaunted the rules (often to slander me), and I am thrilled that Mary Ann appears to be prepared to enforce them.

Tod has gotten away with it for years because councils have been advised by city managers and city attorneys not to engage him because it only makes him get crazier.

Most of the people in the audience that night didn't know who Tod was. When he started verbally attacking people by name, audience members were upset and reacted out of surprise.

Saying that the audience started heckling Tod before he did anything for them to react to is illogical.

I was at that meeting. Tod started out his comments by attacking Hal Bohner, Pete Shoemaker, Pete Loeb, and Ian Butler. He threatened them and yelled at Hal Bohner, "You're next!" That's what people reacted to. They were saying that's inappropriate and out of order.

That was Ervin not Nihart enforcing selected rules against selected speakers, but I don't doubt Nihart was pulling her strings per some agreed upon Contingency Plan in the Event of Tod.

Council has entered an era of making nice with opponents to the highway widening. A ceremonial sacrifice was required. Tod predictably appeared and went ballistic as usual, and was promptly whacked. Means nothing.

Management of City finances are an annual exercise in futility. 3:45 hour city council meeting mostly devoted to another inadequate budget, and all the reasons we fret over funding NGOs. Remember a couple of shelved (always intended to be shelved) consultant studies last year? Wouldn't those unnecessary expenses more than paid for NGO contributions (as minimal as they are)?

Meantime, Mayor Nihart mentioned in San Mateo county, Pacifica has the lowest receipt of city sales tax (about 6%). She also mentioned that Pacifica needs 10 projects like Beach Blvd/Palmetto Avenue to bring-in projected annual city revenue of $500,000 each (or $5 million). That's the city annual budget shortfall.

Kathy, deja vu. That exact remark Nihart made about Pacifica needing 10 projects @ $500K per like Beach Blvd was made by Stone last year or the year before-probably both-during budget charades. Last night Nihart says that Ervin made the speech she always makes. True-though it didn't originate with Nihart. It's been part of the script for every council in the last 10 or 12 years. It's all scripted and rehearsed with roles assigned. They talk, they pose, they gauge the wind, they talk some more, and absolutely nothing changes! Nothing. Hell, even their newly discovered goldmine, the sewer fund, was regularly looted by their infamous predecessors. Clearly, this IS how we live in Pacifica. This council's idea of self-supporting is ask the taxpayer, and in that they are no different than those who so notoriously preceded them. Tey are just slicker. We've been had. Again.

When did Tinfow start? Probably just a scheduled performance review. Original employment contract might tell us. Any performance highlights? Did she come up with the loophole to borrow from the sewer reserve to pay the pension obligation bond? The "outside the box thinker" Nihart was gushing over? I dunno, but that's a dazzling example of kicking the can down the road. Bold. Someone should get a trophy.

From Ms. Tinfow's employment agreement...Tinfow gets annual performance reviews in October. In addition, Council agreed to do an evaluation within 6 months of Oct 21, 2013 (official start date) to determine if a merit increase in pay or other benefits is warranted. Get in the pool now!
